Clinics for Abortion and Reproductive Excellence LLC (“CARE”, “CARE Colorado,” “we,” “us,” or “our”) recognizes the supreme importance of protecting the privacy of your personal information. We have prepared this Online Privacy Policy (“Policy”) to provide you with critical information about the privacy practices applicable to our website, www.carecliniccolorado.com, and any other online interfaces, mobile applications, or digital forms owned or operated by us that link to this Policy (collectively, the “Site”).
By accessing, browsing, or using the Site, you explicitly agree to be bound by the terms of this Policy. Each time you use the Site, the current version of this Policy applies. Accordingly, you must review the modification date at the top of this Policy and check for updates since your last visit.
1. SCOPE AND CRITICAL HIPAA/PHI SEPARATION
This Policy applies strictly and solely to information collected through our Site and online technologies. It does not apply to information collected offline or via clinical channels outside this Site.
IMPORTANT NOTICE REGARDING PROTECTED HEALTH INFORMATION (PHI):
This Policy describes how we handle personal data that is NOT Protected Health Information (“PHI”) under the Health Insurance Portability and Accountability Act (HIPAA) or applicable state health privacy laws. How we collect, use, and protect your PHI—including all personal and health-related information you enter into an official clinical intake or appointment form on our Site (such as our embedded Jotform medical systems)—is governed exclusively by our Privacy Practices for PHI, and NOT by this Policy. If you are a patient receiving healthcare services from us, your medical privacy rights are outlined in that Notice, which is available as a link at the bottom of our homepage.
2. INFORMATION WE COLLECT
We collect two broad categories of information from our Users: Personal Data you voluntarily provide, and Technical Data collected automatically through website technology.
A. Information You Voluntarily Provide
- Non-Clinical Contact & Inquiry Forms: When you fill out general contact forms, subscribe to our marketing materials, or submit inquiries via email, we may collect your name, e-mail address, and phone number.
- Employment & Network Sign-ups: If you apply for employment or join specialized organization networks through our Site, we may collect your contact details, resume, work history, and educational background.
- Online Appointment & Patient Intake Forms: When using online appointment requests or patient intake forms embedded on our Site, you may voluntarily provide your name, contact information, date of birth, appointment preferences, pregnancy- or health-related information, and medical history. Note: As stated in Section 1, once submitted, this clinical intake information is treated as PHI governed by our Privacy Practices for PHI.
B. Technical Data Collected Automatically
To maintain site integrity, performance, and optimization, our servers automatically log technical metadata when you interact with the Site, including:
- Internet Protocol (IP) address and approximate geographic location.
- Browser type, version, language settings, and operating system.
- Internet Service Provider (ISP) and device-specific identifier data.
- Clickstream Data, including the date and time of visits, pages viewed, time spent on specific pages, the website that referred you to us, and general navigation paths.
C. Cookies, Web Beacons, and Tracking Technologies
We and our authorized third-party service providers (such as Google Analytics) utilize cookies, web beacons (clear gifs, pixel tags), and similar digital tracking tools to analyze user interactions, verify server integrity, and secure our network.
- Cookies: You may refuse browser cookies via your browser’s settings. However, doing so may cause certain sections or interactive components of our Site to become inaccessible or malfunction. Unless your browser settings block cookies, our system will deploy them automatically upon site access.
3. HOW WE USE YOUR INFORMATION
We use the information we collect for specific, limited, and authorized business purposes, including:
- Customer Service & Administration: To process appointment requests, verify schedules, and respond effectively to your inquiries, support needs, and customer service requests.
- Site Operation & Optimization: To present, maintain, secure, and improve our website’s public-facing interfaces, architecture, and educational resources.
- Business Analysis & Security: To perform internal data testing, investigate potential fraud or unauthorized site access, defend against technical exploits, and protect the rights, safety, and property of CARE Colorado, our Users, and the public.
- Communication & Marketing: To send updates, information, or promotional materials regarding services available from CARE Colorado, provided you have opted in to receive such communications.
- Legal Enforcement: To comply with all applicable state and federal legal obligations, respond to valid administrative orders, and enforce our Terms of Service or other operational contracts.
We will explicitly request your affirmative consent before utilizing your information for any purpose fundamentally incompatible with those detailed above.
4. DISCLOSURE AND SHARING OF DATA
We maintain strict limits on data distribution. We have never sold, and never will sell, your Personal Information. We do not trade, rent, or otherwise transfer your personally identifiable information to unauthorized outside parties. We share information only under the following strictly bounded legal conditions:
- To Trusted Service Providers: We share specific data with contracted, third-party technology partners who assist us in operating our platform, conducting business operations, or servicing you. These providers include website hosts, data analytics engines (Google Analytics), online form utilities (Jotform), and any other partners added at a later time. It is our mandatory policy that all such third parties are bound by strict contractual obligations to maintain absolute confidentiality and utilize the data solely to perform the designated functions for which we have engaged them.
- For Essential Legal Protections: We will disclose personal information if we possess a good-faith belief that such action is reasonably necessary to:
- Satisfy a valid law, regulation, or enforceable governmental/court order.
- Enforce our Site policies or investigate potential contractual violations.
- Detect, prevent, or mitigate immediate fraud, security threats, or critical technical risks.
- Protect against imminent harm to the safety, civil rights, or property of CARE Colorado, our personnel, patients, users, or the general public. Where appropriate and legally permissible under state and federal law, we will attempt to notify users regarding legal demands for their data. We reserve the absolute right to contest, narrow, or dispute any legal or governmental demand that we judge, in our sole discretion, to be overbroad, vague, or issued without proper legal authority.
- Business Mergers or Asset Transfers: In the event that CARE Colorado establishes a related corporate entity, undergoes an organizational merger, or executes a transfer of substantially all corporate assets, digital user records and collected information are typically counted among the transferred business assets.
5. TEXT MESSAGING (SMS/MMS) AND OPT-OUT POLICY
By voluntarily providing your phone number and affirmatively opting in to receive text messages from CARE Colorado, you provide your express consent to receive Short Message Service (SMS) and Multimedia Messaging Service (MMS) alerts, notifications, and updates regarding your account, appointments, clinical schedules, healthcare services, or relevant clinic communications.
- Opt-Out Mechanism: You retain the absolute right to revoke text messaging consent at any time. To cease receiving text communications, simply reply “STOP” to any text message you receive from us. Upon receipt of your “STOP” instruction, we will transmit a singular confirmation text and immediately cease text communications, unless you explicitly re-enroll or submit a fresh, express consent form.
- Data Privacy & Restriction: We are strictly committed to safeguarding patient communication. Telephone numbers, opt-in consent records, and SMS interaction data will be utilized solely for health-related communications and customer support. This data will never be shared, sold, or leased to third-party marketers, advertisers, or affiliates for commercial gains.
- Carrier Rates: Message frequency varies depending on your interaction level. Standard message and data rates may apply to any sent or received text messages, dictated by your mobile carrier’s service plan.
6. THIRD-PARTY TECHNOLOGY INTEGRATIONS & COMPLIANCE
Our digital infrastructure utilizes market-standard software, and users must understand how these architectures interact:
- WordPress Platform: Our public-facing site is built on WordPress. WordPress manages public text, location maps, and accessibility interfaces, and automatically tracks baseline technical usage data (IP addresses and browser types).
- Jotform Infrastructure: Online intake and appointment requests are processed via Jotform technology embedded directly into our website layout. Data entered into these fields skips WordPress databases and transfers directly to Jotform’s specialized servers.
- Data Encryption & Safeguards: Our Jotform solutions utilize high-level end-to-end encryption functionality. All submitted patient data is encrypted in transit and at rest, requiring unique, restricted cryptographic keys and access codes held exclusively by authorized CARE Colorado personnel to view or decrypt.
- Limitation of Independent Platforms: While we enforce strict security agreements with our vendors, CARE Colorado does not control the foundational code of third-party platforms. Our Policy does not apply to external websites, community forums, or services linked from our Site that are maintained by independent entities.
7. RETENTION AND DATA PROTECTION SAFEGUARDS
We maintain robust administrative, physical, and technical security protocols (including industry-standard firewalls, database encryption, and HTTPS/SSL communication layers) designed to prevent accidental loss, unauthorized access, alteration, or unlawful destruction of your data.
- Access Restrictions: Internal access to personal data is restricted strictly to CARE Colorado employees, contractors, and authorized agents who possess a critical business need to process that data. These individuals are legally bound by stringent confidentiality contracts and face immediate termination, disciplinary review, and criminal prosecution for breach of these duties.
- Retention Schedule: We retain your Personal Data only for the timeframe necessary to fulfill the original business purposes for which it was gathered, as well as to satisfy mandatory statutory retention periods, conduct corporate audits, resolve legal disputes, and enforce our active contracts.
8. COLORADO PRIVACY ACT (CPA) ADDENDUM
Pursuant to the Colorado Privacy Act (CPA) and its specialized state regulations, Colorado residents possess explicit legal protections regarding their personal data.
- Sensitive Data Affirmation: Colorado law strictly regulates “Sensitive Data,” which encompasses information regarding a consumer’s medical history, mental or physical health condition, reproductive health data, or sexual orientation. We do not process, store, or transmit your online reproductive health data or sensitive personal information without your explicit, affirmative, prior opt-in consent.
- Your Consumer Rights: If you are a resident of Colorado, you possess the right to:
- Confirm whether we are processing your personal data and access such data.
- Correct inaccuracies in the personal data we maintain.
- Request the deletion of personal data provided by or obtained about you.
- Obtain a portable, technically feasible, and readily usable copy of your personal data.
- Opt out of the processing of your data for purposes of targeted advertising or profiling.
- Exercise of Rights: To exercise any of these CPA consumer rights, please submit a formal verification request to our compliance department via the contact channels provided in Section 10. We will respond to verified requests within the statutory 45-day timeframe.
9. CHANGES TO THIS PRIVACY POLICY
CARE Colorado reserves the absolute right to alter, amend, or rewrite the terms of this Policy at our discretion. Any updates or revisions will become effective immediately upon being posted to the Site and will apply to all collected data. A physical copy of the current policy is available upon request at our administrative offices.
